These Terms of Service (“Terms”) govern your access to and use of [theplottwisttees.com] (the “Site”) and your purchase of products from Plot Twist Tees.

Plot Twist Tees is a trade name operated as (“Plot Twist Tees,” “we,” “us,” or “our”).

By accessing the Site, creating an account, or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy, and Return and Refund Policy. If you do not agree, do not use the Site or purchase our products.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to place an order. A parent or legal guardian must place orders for anyone under 18.

Our products may include apparel intended for children, but the Site is not directed toward children under 13, and children under 13 may not submit personal information through the Site.

2. Products and Descriptions

We make reasonable efforts to display product descriptions, measurements, materials, colors, and images accurately. However:

Colors may appear differently depending on your screen and lighting.
Placement, scale, and appearance of printed artwork may vary slightly.
Garment measurements may vary within normal manufacturing tolerances.
Product packaging, labels, materials, or specifications may occasionally change.
Lifestyle images or mockups may be illustrative and may not represent exact proportions.

These reasonable variations are not considered defects.

Customers are responsible for reviewing product descriptions, size charts, colors, quantities, and order details before purchasing.

3. Availability and Order Acceptance

Adding a product to your cart does not reserve it. Products are subject to availability, and we may establish purchase limits.

An order confirmation acknowledges that we received your order but does not mean it has been accepted. We may accept, decline, limit, or cancel an order before shipment for legitimate reasons, including:

Product unavailability;
Pricing or description errors;
Suspected fraud or unauthorized payment;
Violation of these Terms;
Shipping restrictions; or
An unusually large or commercially unreasonable order.

If we cancel an order after payment has been collected, we will refund the amount charged for the cancelled portion to the original payment method.

We are not responsible for offers or pricing errors that are obvious or that a reasonable customer should recognize as mistakes.

4. Prices, Taxes, and Payment

Prices are displayed in U.S. dollars, unless otherwise stated. Applicable taxes, shipping charges, and other disclosed fees will be shown before you complete checkout.

You authorize us and our payment processors to charge the payment method submitted at checkout for the total amount displayed.

You represent that:

The billing and payment information you provide is accurate;
You are authorized to use the selected payment method; and
You will promptly update information needed to complete the transaction.

We may change product prices at any time. Price changes do not affect orders already accepted, except where a clear pricing error occurred.

5. Promotions and Discount Codes

Promotions and discount codes are subject to their stated conditions and expiration dates. Unless expressly stated otherwise, promotions:

Cannot be combined;
Have no cash value;
Cannot be applied retroactively;
May exclude certain products; and
May be modified or discontinued where legally permitted.

We may reject or cancel discounts obtained through fraud, technical manipulation, duplication, or misuse.

6. Shipping and Delivery

Orders are processed and shipped according to our Shipping Policy.

Estimated processing and delivery dates are estimates, not guarantees. Carrier delays, weather, customs processing, incorrect addresses, and other circumstances outside our reasonable control may affect delivery.

We will comply with applicable U.S. requirements concerning shipment promises, delay notices, cancellation options, and refunds.

Customers are responsible for providing a complete and accurate delivery address. Contact us immediately at hello@theplottwisttees.com if an address needs to be corrected. We cannot guarantee that an address can be changed after an order enters processing.

An order is considered delivered when the carrier records delivery to the address provided at checkout. If tracking shows delivery but you cannot locate the package, contact us within 03 days so we can review the matter. Our responsibilities remain subject to applicable law and carrier procedures.

7. Returns, Exchanges, and Refunds

Returns, exchanges, and refunds are governed and with these Terms.

Unless the Return and Refund Policy or applicable law provides otherwise:

Return requests must be made within 2 days after delivery.
Items must be unworn, unwashed, unused, and returned with original tags and packaging.
Items showing wear, washing, odors, stains, damage, or alteration may be refused.
Original shipping charges are non-refundable unless the item was defective, incorrect, or otherwise required by law.
Customers are responsible for return shipping unless our policy or applicable law states otherwise.
Approved refunds will be issued to the original payment method.
Financial institutions may require additional time to post a refund.

Sale or clearance items may be final sale only when clearly identified before purchase and where permitted by law.

Nothing in these Terms limits any non-waivable consumer right or remedy available under applicable law.

8. Incorrect, Damaged, or Defective Products

Inspect your order promptly after delivery. If you receive an incorrect, damaged, or defective item, contact hello@theplottwisttees.com within 2 days and provide:

Your order number;
A description of the issue; and
Clear photographs showing the product and, where relevant, its packaging.

We may request additional reasonable information before approving a replacement, refund, or other remedy. Do not return an item until return instructions are provided.

Normal wear, misuse, failure to follow care instructions, accidental damage, incorrect sizing selections, and reasonable variations in color or print placement are not manufacturing defects.

9. Product Use and Care

Customers are responsible for reviewing garment labels, washing instructions, fabric information, size charts, and warnings before use.

Stop using a product if it causes irritation or another unexpected reaction. We do not provide medical advice and do not guarantee that any material will be suitable for every sensitivity or allergy.

10. Intellectual Property

The Site and its contents—including the Plot Twist Tees name, logos, artwork, apparel designs, graphics, photographs, videos, text, product names, slogans, layouts, and software—are owned by or licensed to Plot Twist Tees and are protected by intellectual-property laws.

Purchasing a product does not transfer ownership of any intellectual-property right.

Without our prior written permission, you may not:

Copy, reproduce, modify, distribute, or commercially exploit our content;
Use our designs to manufacture or sell competing products;
Remove copyright, trademark, or ownership notices;
Scrape or systematically extract Site content;
Use our content to train, develop, or improve an artificial-intelligence system; or
Suggest that you are affiliated with or endorsed by Plot Twist Tees.

You may use the Site only for personal, non-commercial shopping purposes.

11. Reviews and Customer Content

If you submit a review, photograph, comment, suggestion, social-media tag, or other content (“Customer Content”), you retain ownership of your original content.

You grant Plot Twist Tees a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, reproduce, display, distribute, adapt, and use that Customer Content in connection with operating and promoting the business, subject to applicable law and our Privacy Policy.

You represent that you own or have permission to submit the Customer Content and that it does not violate another person’s intellectual-property, privacy, publicity, or other rights.

Customer Content may not contain unlawful material, malicious code, harassment, impersonation, confidential information, or deceptive or fraudulent claims.

We may moderate or remove content for legitimate reasons, but we will not prohibit or penalize honest reviews merely because they are negative. Reviews must reflect genuine experiences. Incentives, if offered, will not be conditioned on a positive review.

12. Prohibited Conduct

You may not use the Site to:

Violate any law or another person’s rights;
Commit fraud or submit unauthorized payment information;
Interfere with the Site’s security or operation;
Introduce malware or harmful code;
Access another customer’s account;
Collect information about other users without authorization;
Use bots to purchase limited-stock products;
Resell products where resale is expressly prohibited;
Make false statements about Plot Twist Tees or its products; or
Engage in abusive, threatening, or harassing conduct toward our staff, contractors, or customers.

We may restrict or terminate access, cancel affected orders, or take appropriate legal action in response to prohibited conduct.

13. Third-Party Services

The Site may rely on third-party services such as hosting providers, payment processors, analytics services, social-media platforms, and shipping carriers.

We do not control and are not responsible for third-party websites, services, content, security, availability, or policies. Your use of third-party services may be governed by separate terms.

14. Privacy

Our collection and use of personal information are described in our Privacy Policy.

15. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

PLOT TWIST TEES DISCLAIMS ALL WARRANTIES NOT EXPRESSLY PROVIDED IN WRITING, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL ALWAYS BE AVAILABLE, SECURE, ACCURATE, OR ERROR-FREE.

SOME STATES DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. IN THOSE STATES, THIS SECTION APPLIES ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR CONSUMER RIGHT THAT CANNOT LAWFULLY BE EXCLUDED.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PLOT TWIST TEES AND ITS OWNER, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF BUSINESS OPPORTUNITY, ARISING FROM THE SITE, PRODUCTS, OR THESE TERMS.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM RELATING TO A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT. FOR OTHER CLAIMS, OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO PLOT TWIST TEES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LEGALLY BE LIMITED, INCLUDING LIABILITY ARISING FROM FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, OR PERSONAL INJURY TO THE EXTENT EXCLUSION IS PROHIBITED BY LAW.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Plot Twist Tees, its owner, contractors, service providers, employees, and agents from third-party claims, damages, liabilities, judgments, and reasonable legal expenses arising from:

Your unlawful or unauthorized use of the Site;
Your violation of these Terms;
Customer Content you submit; or
Your infringement of another person’s rights.

This section does not require you to indemnify Plot Twist Tees for its own unlawful conduct, negligence, or misconduct where such indemnification is prohibited by law.

18. Events Beyond Our Control

We are not liable for delay or failure caused by events beyond our reasonable control, including severe weather, natural disasters, fire, labor disputes, carrier interruptions, supply shortages, governmental action, public-health emergencies, power failures, internet outages, or failures of third-party providers.

This section does not excuse obligations that cannot legally be delayed or waived, including required refunds.

19. Changes to These Terms

We may update these Terms to reflect changes in our business, Site, products, or legal obligations.

Updated Terms will be posted on this page with a revised “Last updated” date. Material changes will apply prospectively and, where required, we will provide additional notice or request renewed consent.

The Terms in effect when an order is accepted generally govern that purchase.

20. Electronic Communications

You consent to receive order confirmations, receipts, policy notices, and other transaction-related communications electronically.

Marketing communications are optional and are governed by applicable law. You may unsubscribe from promotional emails using the unsubscribe link provided, although you may still receive necessary transaction-related messages.

21. Assignment

You may not transfer your rights or obligations under these Terms without our written permission. We may assign these Terms in connection with a sale, reorganization, or transfer of the business or its assets, subject to applicable law.

22. Severability and Waiver

If any provision is found unenforceable, it will be modified only to the extent necessary or severed, and the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver of that provision or our right to enforce it later.

23. Entire Agreement

These Terms, together with the policies incorporated by reference and any terms displayed at checkout, constitute the entire agreement between you and Plot Twist Tees concerning the Site and your purchase.

If product-specific terms conflict with these Terms, the product-specific terms control for that product.
